Opos ltd are they fair

My wife has got a problem paying back a loan which was put in the hands of a company called OPOS . in November last year they contacted her and started by quoting that as she hadn't paid they whad got OUR house valued and were going to claim a CHARGE ORDER against it ...Being worried about this i agreed to pay them £102 as the said my anyone on my house would be affected...i checked my small savings account today found that they have since taken 4 payments of £23.50 by using my debit card details which i was unaware off ...they said i agreed to setting up a payment plan ..i have no recollection off do or agreeing to this.and have signed nothing to this affect They say it is recorded the conversation but the only way to get a copy is to pay them...I have now stopped all payments by closing my bank account and put the matter in the hands of the CAB Has anyone had dealings with this company, as in my opinion there are bullies...

    It is becoming more common for unsecured debts to be converted into secured debt by way of charging orders.

    Indeed they can do as they have threatened.

    I would guess they are some way off this though but have just hoodwinked you into making payments, which evidently was successful. It's good that you have savings to fall back on, most people have nothing but food money, hence the reduced loan repayments, so are left with literally nothing.

    It is also common (mostly with PDL Companies) to start taking payments from ANY debit card details they have on file.

    You have done the right thing by closing your bank account. You now have to come up with an arrangement to repay the loan with them.

    I have spoken to the CAB and been informed that they have possibly acted Illegally by making claims which were not true as a charge order is only implemented by the courts and then only after other method have failed...I am hoping that i may be able to get my money back....as it could be suggested it has been obtained under false pretences .....The fact that the loan is also not Mine and as you said they have hoodwinked me by giving me inaccurate information...The £200 they have taken from me is not just savings but subsidises me as my JSA does not pay enough to cover my basic needs...and in the next 5-6 months there is a good chance that i will have my home re-possed or proceedings started against it ...I just don't know what to do......I have been stitched up on all fronts and none of it is my fault......

    Actually it's the OP's wife who has 'got the problem'.

    OPOS appear to be a debt collection agency in Glasgow according to this source http://www.thomsonlocal.com/Opos/0342028401802423000/companyinfo.html

    From the comments posted there, it would not appear they they are well regarded.

    1. clearly not as they have already breached what you thought was your understanding with them
    2. In all fairness your wife has not been fair with them by reneging on her agreement

    the more important question is what due you do about it? CAB is a good call.

    how much does she owe, and what can she sell? Jewellry? Car?
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.

    It's not really an industry that's going to grow love with those who interact with them, is it?

    I do wonder why people put themselves through all the hassle, stress and fuss when they could just pay what's due...or a worst come to an agreement.

    This is what becomes of the old "stick you head in the sand" type mentality.

    I would like to know how they managed to get money out of a savings account when only a debit card number had been given to them?

    A few answers to some of the questions asked

    Firstly how did my wife get into that predicament .....you tell me she is a woman
    sell the car or jewellery ...she aint got any
    she couldn't pay as she lost her Job closely followed by myself
    she did go to debt management but opos will not co-operate...
    she lost her JSA for 3 months ...why the JC gave ner a totally unreasonable Job app that she wasn't qualified for or physically able to do and when she did apply the company fobbed her off so she had no proof and got her jsa sanctioned...this you can check out as i have seen many complaint about this on forums everywhere plus I have also been threatened by them with sanctions...
    The saving account it is a bank account ...but it is used for my savings or emergency fund
    All I asked was...can they do what they have done or doing ...I can appreciate that my wife has only got her self to blame over her money management I am trying to cope with it and sort it out and i would be grateful for any constructive advice i can get .....
    PS THE CAB ARE INVOLVED

    First & formost , call the bank report all cards as stolen , get new cards - the banks will given them money - even if it make u overdraw & will then charge u , open a savings account - with no debt cards - for wages or any form of money in , draw it out from hole in the wall to pay any bills , get cab to write & offer £1 per month - also request payment book or bank details , so u can walk into a bank quote your ref & pay in cash , do not open any doors to any debt agency , NOT EVEN ONCE , if they don't get any answer the first time they are not allowed in & are not allowed to break in , if u let them in even once , they allowed to breakin the second time , they can't touch u if u not let them in once - Its the LAW , & the worst they can do after that is make u Bankrupt , U Stick with that they Can't touch u
