PPI Claims

Hi

I'm hoping for a bit of guidance.

I'm following the excellent guide on the main page regarding credit card and also loan ppi. I sent off for the T&Cs and have got replies from both, but unsure of what route I should take now. The replies aren't what I expected them to be, I'm snookered already :)

I'll start with the Bank Loan as it seems pretty straight forward. The problem is it was a continuation loan to pay off an existing loan and also give me some cash. When I received the T&Cs it was only for the existing loan I have now, no T&Cs for the one before. How would I claim for the original loan, would they do it automatically when dealing with this, or do I need to get back in touch and ask for copies of previous agreements?
Regarding the Bank Loan, from reading the forum I'm pretty sure the ppi was front loaded. My agreement has 4 sections, 1 Cash Loan, 2 Loan to Repay Existing Debts, 3 Loan for Optional Repayment Protection Insurance, 4 Total Amount of Credit and underneath each, two boxes with Amount of Credit and Total Amount Payable. Is that front loaded? I'm sorry for the long winded stupid explanation but I just want to be sure if it is

Now the Credit Card.
Originally the card was with Citi, now Opus and was a postal application.
The agreement I received is just a standard T&Cs with name printed on, not a copy of the original with a signature or anything. The letter states "We enclose a true copy etc" The copy does not include the signature box, signature or date of signatures as in accordance with Regulation 3(2)(b)(ii) of Consumer Credit Regulations 1983.
I sent the templater letter to Opus. Is that who I should be dealing with, or should it have gone to Citi? What would be my next step, SAR, and to whom?

Any input much appreciated

Regards
Mick

Re the loan, when you put the claim in for mis sell, front loaded is the reason here, tell them you repaid the previous loan from this one and ask them to look into this, when you settled the first loan you would have had a rebate for the PPI but the remaining PPI will be on the top up loan!!.

Re the CITI card, is this card closed?, if it is I am surprised they gave you the T/C, if it is still open, PPI will show on your monthly statements, if you paid this and have reasons for mis sell then put a claim into Citicard.

If the card is closed, then do a Sar to Citicard ask them for all information they hold on you, enclose £10 and give them 40 days to respond, this should get you what you need.
If you got a copy of the cc agreement there may not be PPI on there, sometimes it is added at a later date.
  • Hi amersall

Thanks for the reply, a big help.

The cc is still open. I did have ppi on the card but when ppi started hitting the news I cancelled it, sometime last year I think. I'm not even sure if I was miss sold or not, its a long time since I applied. I'm pretty positive I wouldnt have ticked the box, and cant recall a telephone conversation about it. Foolishly I always thought it was a part of having the card and never queried it.

While searching for Citi in the forum I came across this post. I can say with 100% certainty that the same thing happened when the card switched to Opus
