Father made redundant - starting business

Just looking for some advise for my father

My father has been made redundant and he is looking at starting a business, he cant actively look into doing this as it will be working in direct competition to his ex employers and he has been put on gardening leave for 1 month

He has however been speaking to some friends who own businesses and one of them have said that if he is starting up a business he will be entitled to receive some tax back that he has paid over the last 6 years. Does anyone know if this is true?

    Every year is worked out individually so he's only going to be able to claim any entitlement for this year, and if he's being paid for the next month he's been paid up until the end of this tax year so i doubt he'll get any rebate at all.
    If he's been made redundant i don't see why he isn't able to work in competition against his old employer.

    Thank you we thought it was too good to be true ha,
    He can set his own business up after one month as he is still employed until mid April.
    He has spoke to a solicitor and they have said he can look into it but needs to inform his ex employers of his intentions and this may affect his redundancy money, the solicitor said they can't directly stop him making a living but said they can make it difficult for him when it comes to suppliers etc ..
    When he had his meeting it was outlined that he wasn't allowed to contact any clients etc for one month or he will be in breech of his contract but after the month he can do what he wants,

    if he is on garden leave he is still employed.


    The thing to do is setup the business ready to have a flying start without breaking any of the restrictions in place while being a employee of the current company or any restrictions that may continue after.

    it's probably worth waiting till the moneys due are actualy paid.

    DO NOT tell the existing employer what the plans are they can withdraw the redundancy.
