Capital one 18 month BT card

Does anyone know if Capital One have to accept a certain percentage of people for this card?

I know new regulations are in place that say that the interest rate advertised must be available to 66% of applicants, presumably to stop providers advertising a fab rate but that is only available to very few people.

Does this also apply to the length of the interest free period? I got turned down for the 18 month card and offered a 6 month one last time I applied for this offer in October. This was before the new rules came in at the begining of November.

Hopefully I'm not in the 'bad' 33% so it would be very handy if they had to give 18 months to 66%!
