Sold a dodgy car, need advice!

Hi,

I bought a car this Saturday, a Xreg (2000) Seat Leon Cupra, 130,000 miles for £995, which I thought was a fair price for the mileage.

As part of the deal I P/X'ed my old car for £600 and paid the remaining £395 by credit card (added protection if things went wrong)

I taxed the car today, and after only 20 miles, the car has now started making a terrible engine noise, and I am not driving it until it is fixed.

Obviously I understand the vehicle is probably not going to last more than a year or so for that price, but only 20 miles is a bit soon.

On the invoice from the dealer, it states 'TRADE SALE INVOICE' at the top, and the usual car dealer rubbish 'This vehicle is sold without additional warranty or guarantee to that implied by law'.

I know the 'additional warranty' clause is rubbish, as you have your rights under the sale of goods act, but does the fact that the invoice clearly says 'TRADE SALE' at the top and the fact it was sold without tax make me exempt from any consumer rights, and it is technically classed as a trade sale and sold as seen??

Any help would be appreciated, cheers guys.

as a consumer your sale of goods rights can't be removed but reading your post it doesn't seem they are trying to.

The way I read it they just haven't given you any additional warranty or guarantee over & above that implied by law i.e. nothing over & above your SOG rights

Haha funny you should say that, he didnt really inspect it, just looked at it and said '£600 for that mate'

Not had chance to speak to him yet, it just broke down tonite, i only actually got it taxed this afternoon and its my first drive in it. I just like to be armed with the facts first

Cool, it just looks like its riddled with words and phrases that they could try to use if I did go back with any issues. I'll speak to them tomorrow and let you know how I get on.

What kind of terrible engine noise? If it's shuddering, it's probably a coil pack.

Is the engine management light on?

Exactly what I was thinking, if it sounds like it's running on 3 cylinders then it probably is. The 1.8T is bad for coil packs - luckily they're relatively cheap to replace.

Btw £1k is far too cheap for a leon cupra, even an early one

When dealers sell to each other they issue a "TRADE SALE INVOICE" which means there is no warranty or come back. You should not of accepted such an invoice. Based on what I know from a dealer SOG does not apply to inter-trade sales as dealers should be experts and know what they are doing.
