Advice please .

I have received a County court Claim form saying that i owe 1223.37 and the debt is with Provident personal credit . I have never taken a loan out with Provident its in my old name which i haven't used for 8 years what is the best advice in dealing with it

    provdent have been buying old debts from other companys so it could be something you owed a long time ago to someone else? you need to ask for information using the cpr to find out what it is. if not yours then defend denying the debt. if yours but statue barred then defend that way.

    I just spoke to the credit people and they dont have any agreement as they say its "a old debt"
  • i had same trouble man from provident turned up [memory think did owe mobil 3 100 quid]
    the bill was stupid amount which i said was not correct at the time thats well over 5 years + ago i never refussed to pay it just said the amount is wrong. [never recived contact off anyone either]
    this guy turns up with bill for 1,222 and another one for over 400 quid.
    so just waiting to see what happens now, guy stated return the debit to head office, as its disputed.

    County court summons? Go along and argue your case. What evidence do Provident have that you are the debtor? Send a Prove It letter to the credit demanding an explanation.

    My guess is, it's statute barred, so what the heck they are doing trying to go to court is anyones guess. You definitely need more information though. What else do younhave that sheds light on this?

    must not ignore the court summons. if you do that they will get a judgment by defauly

    I no for a fact that i have no debt with Provident never had any dealings with them at all. I haven't use the name that it's addressed to in over 8 years . I called them asking what debt it was and can they send me the credit agreement they said they haven't got a credit agreement .. as it was a old debt . If provident have bought the debt then its got to be over 6 years old and i really can't remember running up a debt for this amount . She just kept asking for my old address i didn't want to give her any information over the phone . I can't got to court its to far as i have no way of getting there . Any idea what i can put on the claim form All this help is gratefully received thank youu x

    Is it definitely a county court summons or are they just threatening you with a county court summons.

    Can yu scan and post the paper.

    Ask them how old the debt is. If its more than 6 years old they can chase you for it but its normally unenforceable.

    Says on the forum The claiment in respect of a credit agreement between Provident Peersonal Credit and the defendant under account number .....

    The agreement was terminated as the defendant failed to maintain the agreed terms . ( note not had any contact ) . In accordance with the pre action protocols the claimant has attempted to contact the derndant and agree a repayment plan . the defendant has failed to repsond or aintain a sutiable arrangeent . Proveident personal credit has sold and assigned all rights title and interest under this agreement to wescot ...

    and the claimant claims interest pursuant to seciton 69 of the county court act 1984 at the rate of 8% per annum from the 03/4/2007 to 19/032012 totalling 306.27 and thereafter at a daily rat of 0.17 to date of judgeent or sooner .x
