Redundant after 8 months

Options
Hi all

I have been made redundant after just 8 months of employment. i have been looking through advice sites and most of the news is pretty dim and pretty unclear on what i'm entitled to. i was just wondering if anyone could let me know what i am entitled to and what questions i should ask in the meeting i have later today.

Cheers in advance

As you have less than two years service, as far as I am aware, you are entitled to no redundancy payment. You may be entitled to something for unused accrued holidays, though.

You're not entitled to any redundancy pay as you have not been employed for two years. However you should ensure you get contractual notice or pay in lieu of notice, and any outstanding holiday pay. Depending on the number of redundancies there may be consultation obligations on the employer also.
  • 3 of us are being made redundant today and the last three will be made redundant in the near future when the company closes. do i get all my outstanding holiday pay or just part of it? e.g. i am entitled to 24 days a year (excluding bank holidays) i have used 7.5 days to date (starting january). do i get a reasonable amount of the complete years entitlement of holiday or the whole lot?

You would get a pro-rata entitlement which from Jan-March would be approx 6 days, so as you have taken more that that you will not get a payment and depending on whether they are being really stingy, and providing they give you notice in writing, they could make a deduction for the extra 1.5 days. Sorry!
  • isnt it calculated til the end of april? since thats the end of the contractual notice period?

You said you were "being made redundant today", and that is what I based my answer on.

Yes if your notice takes you up to the end of April it would be 8 days. But if you are being paid PILON and your contract terminates today then no.
  • oh i didn't realise it worked that way. okay thats good to know thanks
