Natwest Information Request

Hi Can Anyone advise me on whether this is right ..
I applied to Natwest for information regarding a bank loan I took out from them in 2008 n finished paying in 2010 to see if I was charged PPI ...as I no longer have any paperwork regarding this loan.
They have since replied telling me that because the loan has ended they have no obligation to provide me the information I requested.
So how am I suppose to claim bk any ppi that might have been mis sold?

    Hi there
    They should still hold other data of the loan, but you do not require this agreement if you know you were sold PPI and have your reasons to make a reclaim.

    You just complete the reclaim questionnaire that were issued by the FOS for customers to make a complaint/reclaim, complete and send to the ones responsible for selling you the product, remember to keep copies in case you need to refer back to it again at some point.

    If you made a request using the £1 request under the consumer credit act then their response is correct. That method only applies to debts still outstanding.
    So how am I suppose to claim bk any ppi that might have been mis sold?

    A copy of your agreement doesnt tell you that you have been mis-sold. There is and never has been any requirement for you to obtain your agreement to make a complaint. You contact Natwest and tell them you wish to make a complain and give them your reasons for complaint.

    There is nothing wrong with having PPI or any other insurance. The whole issue is about how it was sold to you and if it was done correctly or not.

  • I also sent them a £10 P.O with the letter to which they sent bk to me , I don't kno if I did have PPi on the loan , to which is why I requested the original agreement to see if it was on there , Not really sure where to go from here ?

    Hi Sorry for the delay in responding.

    As you sent the £10, I assume that was for the Subject access Request a full (SAR) and not just for the agreement.
    For the agreement it is normally just that of a £1.
    As this was settled in 2008, that was 4 years ago they should still hold at least some details of the account as they should do for at least 6 years, some will hold data for even longer.

    There is a full SAR letter below if you have not used that letter and just that of the agreement request.

    they must comply to this under the data protection act, (DPA) any problems contact the Information Commissioners Office (ICO), google that in and more details will come up.

    However, what you could do is ring them and they should confirm if any ppi or not.;)
    If you believe you have any reasons for being mis sold then reclaim, it appears that your not sure, so in your case if it is added, then its possible they added it without you being aware, that is one reason where you can complain.

    As dunstonh says though, there is nothing actually wrong in having PPI, but if you did not require it or was protected with another policy, such as a stand alone, or had pre med conditions where it would have failed on making a claim if you wanted to claim on this, that is also another reason, the list is endless, so always worth checking to see what may apply to you.
