Getting deposit (rental) back from repossessed house
Worriedmummy
Hi Everyone,
As per my other posts (be warned there may be a lot of them over the next few weeks).. We are currently looking at new rentals because our LL is currently having the house we live in reposessed..
My next question is.. My deposit is in a secure scheme, but it says that authorisation needs to be given by my landlady to release it... my landlady has disappeared of the face of the earch and we have been paying receivers since may 2011. How do I get my deposit back.
Plus, on a more cheeky note, will they still expect me to get all the carpets and curtains professionally washed as per landlady stated when its going to be repossessed? I'd be a bit annoyed really if they made me considering they havent even done the annual boiler check.
Any advice welcome.

Why have they not had the annual boiler service done ?
Write to them asking for it to be done asap
Contact the DPS and tell them your current situation RE Landlady GONE0 -

Contact the DPS and tell them your current situation RE Landlady GONE
WRITE (yes, WRITE - or email..) to DPS and explain.. This must have happened before: Ask them what they do in such circumstances...
Re Boiler check, ask (again WRITE!!) new owner (presumably mortgage company/receivers..) to sort this safety check out quick. THEY are now responsible..
Hope the next place works out better!!0 -
Thanks guys,
I have emailed the receivers on numerous occasions about the boiler- they just don't reply. I've emailed and tried to get hold of them by phone about the deposit too with no joy!
Its not just my deposit that I need confirmation from them about - I need something in writing from them saying that we can leave the house asap (our tenancy agreement isnt up until September, but I'm not sitting around until then worrying about the repossession)... oh its such a mess. The solicitors acting on behalf of the bank (who will probably take the house over from April as the hearing is the 3rd) seem to think its ok for me to move about, but said they can't advise me on the deposit.. not their problem I guess.
I have phoned the deposit protection scheme, who didnt seem to understand what I was on about ... I don't think they actually believed my story, so i will try and find an address for them - I can't find an email address for them anywhere.
For clarity its one of the grace and co properties I've been renting - I believe there are lots of other people in the same boat as me as there are 50+ properties across the country..
With all this and worrying about credit checks on the new place I actually think I'm close to having a break down:(2012 wins = £933 :j

Have you looked at the DPS process for releasing deposits......?
"Request repayments
Landlords, agents and tenants can all request the repayment of a deposit to the appropriate parties at the end of a tenancy - either jointly or independently, online or by calling us and requesting a paper form.
When one party requests a repayment, the other needs to confirm whether they agree with the proposal, by completing an acceptance form - either online or by post. "
If a request is made, and the other side does not respond, the single claim process can be used:
"In these circumstances the Single Claim Process is available.
The Single Claims Process is a method of repayment for use by a Tenant if:-
a) the Tenant has no current address for the Agent/Landlord; or
b) the Agent/Landlord fails to respond to the Tenant’s written notice asking whether the Agent/Landlord accepts that the Tenant should be repaid some or all of the Deposit within 14 calendar days of the end of the tenancy.
If you would like to start the Single Claim process you can do so either by logging into your account and selecting "Start Single Claim Process" from the repayments menu, or you can start the process using the Online Form. "0 -
Thanks G_M thats really helpful and a relief!
I'm guessing that If I go for point a) Landlady has disappeared..then I won't have to wait until the end of the tenancy agreement as you do with point b)??
Either way I know I'll get it back sooner or later.
I have to say that I don't know where I'd be without the help I've got from this site in the last week or so. I'm now feeling a lot better about getting my deposit back and a lot more confident about credit checks (as I haven't got any of the publicly available nasties they look for like CCJs, IVAs, Bankruptcy etc.) ... plus viewed a stunning house today which has been reserved for us! :j2012 wins = £933 :j
