Victimised by RMA/Egg/Barclays

I had a egg credit card and november 2011 i was contacted by RMA and offered a settlement figure which i accepted and paid £1800 against the balance of £4888. RMA told me the remaining balance will be written off. at the same Barcalys purchased Egg. and barclays started issuing new credit card to replace the egg card number.

last week Barcalys excersied their legal rights to set off payment of £3088 from my barclays current account without contacting me. this is the 1st contact i got from barcalys. letter said we have been unsuccessful trying to contact you and therefore we used our legal rights to debit your barclays current account.

I called barclays card today and complained. they are now investigating. they said under the new barclays card number there is an outstanding balance of £3088. i did explain to them please look under my previous card number with Egg. they confirmed there is a payment made in December for £1800 which came from Debt management agency.

I called RMA today and they did not have my details - its really shocking. i looked up on my bank statement. i can clearly see £1800 transection debited by NCO europe (parent company of RMA).

I am completely lost right now. Barclays asked me to call back within 2 days. they could not find any notes of the system why the £1800 payment was made.

please help me.

    You must have had that 'full and final settlement' in writing and the account would have been closed
    ........and barclays started issuing new credit card to replace the egg card number.

    Did you never question why you received a new card for a closed account and what balance did the statements show?

    Present them with your copy of the agreement or at least a contemporary note of your conversation: date, time, person spoken to, etc.

    A defaulted account.

    AAnorthwest - my apology . i didn;t get a new card but a letter to say that new card will be issued but never received it. i guess its a standard letter went out to all Egg card holders.

    Present them with your copy of the agreement or at least a contemporary note of your conversation: date, time, person spoken to, etc.

    AAnorthwest- I can see in my bank statement when the payment was debited from my account.

    If you had a credit balance, then the card company have the right to offset against another debt.

    If you had the £3000 in your current account, why didn't you pay something towards the cc debt?

    Surely not if an account has been paid in full and final settlement with the RMA whilst it was an egg debt(before barclaycard took over)

    Do you have written proof that the payment made to RMA was in full & final settlement of the debt and that neither they nor anyone else would chase you further for the debt - or words to that effect?

    If not then you may well struggle to get anywhere.

    If you don;' have that paperwork and RMA are saying they don't have details of the account then you might want to do a subject access request for £10 to RMA to get copies of everything they hold on file about you and your account to see if there is anything there that is useful.

    In the meantime I would write to BC to state that you dispute the debt and the offsetting as you had previously settled the debt with RMA. (Even though you've spoken to them I would send a letter follow up so you have proof at a later stage).

    In order for such a generous full and final settlement to have been made I would imagine defaulted some time ago.

    Why therefore are barclays continuing to take (presumably direct debit) payments from your bank account showing the card number? Why was such as full and final settlement offer made to somebody who is making regular dd payments to the card account?

    It was a defaulted egg account. And so egg had no way to offset funds and therefore a settlement was offered by their appointed debt collectors.

    It was only when barclaycard bought the account that they than had the ability to use the right to offset as the OP had other barclays accounts. Which they then exercised.

    I don't think there is anything to say that he was making regular dd payments to this debt from anywhere.
