PPI reclaim, unusual scenario

Hello all, I am not sure if this is in the correct section so mods please move it if its not. I am at the moment trying to process a ppi claim with Barclays.
I had a loan with them that ended around a year ago that i was obviously paying ppi on. During the 10ish year period of the loan i did make a claim on the ppi. The reason i claimed was because i got made redundant, and after a couple of months of them supposedly paying the loan for me i noticed that i seemed to be having a lot of money going out of my account. I rang them up and they said that there had been an error. They said that they was paying the loan for me, but that i was also paying the loan, meaning it was being paid twice. This caused me to go over my overdraft on many occasions before i realised causing me hundreds of pounds of overdraft charges. I still have no proof that they was even paying it during this period of me being out of work.
This i think puts me in a rather different position because they have obviously gone out of line with the service that i was paying for.
So i sent them the initial letter asking for terms and conditions, but i added a bit at the bottom that i would also like a breakdown of the payments that were made on the loan during the period that i claimed ppi.
They very kindly sent me a letter saying "Thankyou for your request for a copy of a credit agreement and financial statement. Our systems show that there is no sum payable under the credit agreement and therefore there is no requirement for us to comply with your request"
I am actually unsure of what they mean by this, can anyone be kind enough to claify to me? and what action would you suggest from here?
thanks in advance for your help
James

Hi James,
The statement
"Thankyou for your request for a copy of a credit agreement and financial statement. Our systems show that there is no sum payable under the credit agreement and therefore there is no requirement for us to comply with your request"
Means they do not have to supply you with what you have asked for due to the loan being finished. This is correct.
What you should have asked for is a SAR request which costs a one off fee of £10, they then have 40 days to supply you with all they hold on record for you. This may or may not show up what you are trying to get (proof that you were still paying for the loan despite putting in a claim)
This is a difficult position as you say and all I can suggest is if you have any statements from the time you were redundant to prove you were paying the loan whilst unemployed, photocopy them and send them in with a covering letter. The SAR may shed some light but not guaranteed

thanks for your reply, do you know if there is a limit to how far back i can request statements? as at a guess i would estimate i was made redundant around 6 years ago now0

The SAR will provide ALL the Bank has on record for you while you've been banking with them. Whether all the information you require is still on file, you'll only discover when you receive the SAR report.JamesHiggon wrote: »thanks for your reply, do you know if there is a limit to how far back i can request statements? as at a guess i would estimate i was made redundant around 6 years ago now0 -

6 years is about the limit, but you never know how far the banks records go back. Also requesting statements can cost £5 each and if you don't get any from that period you will be throwing money away. I would SAR them for the £10 if only to rule that route out or try the free trial credit report route to see if that throws anything up. Then take it from there

so what does this SAR actually contain? all of my bank statements for the past 6 years and all info on any credit cards/loans i have had? basically all the information about my whole banking history with them?0 -
It's not in as much depth as reams of banking statements would be of course.JamesHiggon wrote: »so what does this SAR actually contain? all of my bank statements for the past 6 years and all info on any credit cards/loans i have had? basically all the information about my whole banking history with them?
It will mainly contain summaries which include loan amounts, account numbers etc.0 -
You will only get what an office worker can find without too much digging, basically what's in filing cabinets, they won't go down to the basement and dig out archives. Having said that you never know until you try. Some people have got lots of information going back years and years and I have heard of someone getting everything in code and abbreviations that mean next to nothing to the man in the street. When it boils down to it , it's worth £10 just to find out

If you have the account number and reasons for mis sell put the claim in, tell them this was front loaded ppi and you want refund of all premiums back with interest.
Put about the claim you made and what happened and ask them to look into this too, you have in effect being paying for this ppi twice.
If you do not have the account number then ring them as this was only cleared 12 months ago they should still have your details, they could find you from the address.
