It seems to me that you are looking for an excuse to get out of your tenancy early.johnny_kidd wrote: »I am wanting to obviously get out of the contract early but this was not my intention . I signed the contract believing i would be staying for the full term. But things have changed. They do need to protect your deposit, which they may or may not have done. It would be an idea to continue to question this.0

Do not use recorded delivery. LL can refuse to sign for it and then you are several weeks down the track and having to start again. Ordinary first class post plus a free certificate of posting. It is deemed to be served 2 working days later.0

Agreed Yorkie!
Either rentergirl gets commission from the Post Office for recommending recorded delivery, or she is just well ... hard of understanding to put it politely!
How many times have we all corrected her here - NEVER recorded delivery. If not signed for, it sits in the sorting office for around 10 days until someone can be arsed to collect it. If they don't it is returned to sender.
And this from a poster who apparently runs a blog advising tenants on letting rules and regs ... words fail me!0 -
I agree - when I have posted a correction on this point previously, she responded that recorded delivery is "standard practice", but when I asked her a) to cite her authority, and b) what advice she would give (and what accountability she would accept) when her initial advice led to a T being unable to prove service at a crucial time owing to non-delivery/signing for RD - thus leaving the T liable to further expenditure / inability to move, she failed to respond.0

Your best (and morally right) bet is to find new tenants. Most landlords will let you out of an agreement early if you find a replacement to take up the remainder of your tenancy.
You can advertise online for free on gumtree, tepilo, vivastreet. Also put signs in the window and in local shops.
I have written a letter advising of my situation and sent it recorded delivery - if no answer within a week I will send again via 1st class along with demand for details of deposit scheme. Hopefully they will understand my situation and allow me to advertise on some of teh above mentioned sites - thank you0
