Hi all,
I wanted to know when the Register from the Land Registry has family names under the Lender(s) section, does this mean the person's family has taken out the mortgage and put the person's name on the title deed?

Effectively yes. So no joy there, you'll just have to deal with their noise as noise rather than go round the back door to get at them.Hi all,

So I canto do anything even if Schedule of restrictive covenants states at point 2:
"The land hereby transferred or any part thereof (hereinafter
called the land) or any buildings to be erected thereon shall not
be used for any manufacture or any offensive noisy or dangerous
trade business pursuit or occupation or any purpose which shall or
may be or grow to be in any way a nuisance damage grievance or
annoyance to the Vendors their successors in title and assigns or
their tenants or to the owners or tenant of any of the
neighbouring property or the neighbourhood or which may tend to
depreciate or lessen the value of the adjoining or neighbouring
land of the Vendors or any part thereof as residential property."
Aren't the neighbors in breech if this?

So I would be thinking that the registered proprietor's relatives loaned him some money and so have their names registered as mortgagees.

Well, if that covenant relates to the property where the relatives have a mortgage, then if they are making a noise, they could be.
Question of whether OP could enforce it - that's another issue entirely as to whether his property has the benefit of the covenants - but frankly if it is really bad, much easier to complain to local Council noise nuisance people than mess about trying to getting an injunction for breach of covenant.RICHARD WEBSTER
