Hello everyone,
I've been parking in this car park for months on more or less a daily basis. There is a common practice of many motorists parking outside of the marked bays, a practice which I have observed and took part many times in without attracting a single parking ticket. I actually think it is clever of Excel parking to allow motorists to park outside of the bays (as long as no obstruction is caused) as this allows more motors to enjoy the cheapest daily rate in the centre of Sheffield.
The convravention code is "86 - parked outside marked bay" however by 9am everyday the car park is full, all the usual marked bays and all the "make-shift" unmarked bays motorists use, i.e. against pillars etc are full, so I could easily go back in and take pictures of this. My defense is that this contravention is not applicable in this car park due to this common practice which is clearly endorsed by Excel themselves (why wouldn't they, it's more revenue for them).
Shall I do nothing and ignore the subsequent letters or appeal? The only problem is this car park is full of CCTV and they will have evidence showing I was the driver so there's no back-up in the very unlikely event of this going to court.

You should do nothing, and ignore them, but not for those reasons - the reasons are that in reality they are entitled to pursue you for their actual losses only, under contract law. I'm assuming this is either a free car park, OR you paid for the parking, so these losses are zero.

Thank you for that clarification ManxRed, yes I had paid for the parking, I have kept the display ticket and they even noted I'd paid on the slip itself.0

I like that bit about "convravention code 86" anybody would think they are trying to pretend it's some sort of official parking ticket.

You have not been given a parking ticket !
what you have got is a flyer left on your windscreen from a company impersonating authority.
They are a private company and have no legal or lawful course to issue a fine of any description.
Legally what they have left you is an invitation to pay a private invoice.
My advice is you reject the invitation and keep your money
If they think they are owed it, let them try and prove it in the civil court, as they have suffered no loss by your actions, in fact gained by them if anything if they are saying your payment was not valid, then they owe you it back.
Do not confuse this with an official police or council ticket, it is neither, but a clever impersonation of one.
Ignore it and you will get several silly letters, the characters in the impersonation will change to debt collectors and fake solicitors, all again an impersonation, then eventually they will give up.

Excel's could not have created that list by chance. It was clearly copied for a purpose and one wonders what that might be? Might it have been for what could be called misrepresentation of authority?
The part listing I gave above had been singled out - for the purposes of the tax tribunal case - because it was deemed that they appeared to represent trespass rather than breaches of contract.
