I would tell them that you will agree to end the tenancy earlier as requested, but that you do not expect to be out of pocket as a result. You expect your full deposit to be returned and that the landlady meets your removal costs. Failing this you will see out the rest of your contract.

As long as you pay your rent on time your employment status is irrelevant.

I certainly would not be taking another property from remix, giving the bad & false advice they have given you about the landlords right to terminate the contract.

Agree. They are using your Claimant status to intimidate you. Remain calm, and polite, and if you can ask the over-worked Shelter and CAb to write a letter on your behalf. Some compensation would be useful right now, I'd imagine.

You have to call in person mostly nowadays. Get there when the office opens.

You haven't had any form of notice in writing yet have you - you said the landlady gave you notice verbally. They have to give you notice in writing no matter what grounds they are saying they are using. If you get something in writing from them that is when you must check it out with Shelter or CAB or local council to see if they have given you a valid notice or not.

The stuff about you having to be employed is just a lot of nonsense.

I think I agree. It seems to me that they will never do this in writing, because they will be wrong. OP, I think that they are trying to talk you into going. Just sit tight and wait for them to put something in writing. I doubt that they will.

Please keep us updated OP. Nothing better than seeing unscrupulous landlords and incompetent letting agents having it stuck up em.

Suggested trim on your draft letter - keeps the important points but loses the rest. I understand the urge to explain yourself but you really don't need to - they are in the wrong :).

I honestly wouldn't bother including the employment status paragraph - if it's not covered or mentioned in the tenancy agreement then it's totally irrelevant.

You're probably right, I only left it in to forestall a response of ... "but you broke the contract because you're unemployed".

Far simpler to let the LL/LA tighten the noose around their necks by stating, in writing and without any prompting, an unfair unilateral variation to the contract that the tenant originally signed ;)

I agree with chris_m - leave that out and see if they are stupid enough to put it in writing.

The only other thing I might do it to indicate that you expect all communication to be in writing. I suspect that they will get your letter, then call you and kick up a stink. Screen your calls, ignore anything from them and wait for them to commit their nonsense to paper. If they insist on calling, you could always record your calls (if you can) - just remember to state that at the start. "Oh hello, just so you know I'm recording this call." I suspect they will stop calling after that. Better to get them to write though...

It doesn't matter what she told RE/MAX about whether she wanted employed people or not. That's between her and the letting agent, nothing to do with you. In any case, anything that she put in the contract about this would not be able to override your statutory rights.

Your contact is with the landlord. Your contract extends up until August 2012. You don't have to leave until then as long as you keep up with the rent. It's as simple as that. Ignore any other attempts to confuse the issue. You have no obligation to negotiate or even talk to RE/MAX.

Tell the landlady you will be seeing out your contract, and not to bother you again.

^This, plus make sure you change the locks so you won't come home to find yourself unlawfully evicted.

It's also time to refuse to communicate with either the agent or the landlady except in writing. Don't help them to evict you by telling them what they need to do either. ;) It sounds like they have no idea of the correct proceedures to follow so let them get on with it. Just state that you will be seeing out the contract and that you expect "quiet enjoyment" of the property as is your legal right. Do not get into a discussion re. your employment status - it is irrelevant so long as you continue to pay the rent and just muddies the waters.
