PPI Claim Knocked Back - Lloyds/Blackhorse - Now What?

I applied to reclaim the PPI I had on a car loan provided by Black Horse Finanace that was taken out in March 2006.

The claim was based on the fact that I didn't want the PPI but was pressurised in to taking it with scare tactics. I never wanted the PPI.

So I filled in an online PPI claim form on the Black Horse website. I have received a letter from them in response to my claim telling me that they do not believe that there is sufficient evidence to agree with my allegation of mis-selling.


What do I do now?

    You have 3 options. 1) just write it off and move on. 2) complain to the FOS 3) take them to court.

    I would have a good read around about both FOS action and court action to decide which is best for you.
    TBH if you go for court I would say the CAG forum is better for info than on here as they are a litigeous lot over there lol.
    For FOS there are many cases on this forum and you can give them a ring and they will discuss things with you and start a claim if you wish.

    What do I do now?

    What evidence have you supplied them to support your allegation? If it is your only complaint reason then it is the weakest type going and it is normally rejected as you have no way of proving it and you could just be making it up. It's a he said/she said scenario.

    However, many Black Horse complaints succeed with single premium front loading being the valid reason for complaint. Did you mention that in your complaint?

    Although Black Horse have won in the courts as the PPI issue is mainly an FSA thing and not a legal one.

    Court action can go wither way as can FOS. Court action is quicker and can produces higher awards, BUT initial costs can mount up and there is a lot of work involved, plus you need to read and understand on what legal grounds you are proceeding with action. It is an option, tbh for most people (me included) the FOS is free and they do the work, although you get less back and it can take a very long time.

    The FOS apply FSA rules. The courts apply the law. The PPI issue is an FSA ruling which the courts do not recognise in the same way. So, you cant use the most of the reasons people use in the regulated complaints process in the courts. Black Horse, had a 99% uphold rate at the FOS. Yet were winning in court.

    In some areas you would be right but with PPI, I think it is a massive risk going with legal action.

    Legal action sounds like a bad idea for me.

    FOS all the way. I understand what you're saying about "he said/she said".

    The response I got from Blackhorse kept referring to "their evidence" but never stated what their evidence actually was, which makes me feel that I got a mail merged letter. I genuinely never wanted PPI and didn't really understand whether I needed it or not. I was only 21 at the time so I didn't know anything about anything! I genuinely felt pressured into taking out the policy. But that is up the FOS I guess.
