Memorandum of Sale

Hi, Is it usual for an Estate Agent to send a Memo of Sale out to everyone in my chain and list my home phone no. This is not our EA, we are buying from them.

Im pretty angry about it as everyone has my home phone no. now!

So who has your number that wouldn't otherwise have it? only your sellers and their solicitor. TBH having each others phone numbers will mean problems get sorted quicker and you will have a smoother ride. I can't see a reason to object.

  • When you say the whole chain - how many of you are there in it?? I would object to having my telephone number given to the other party without my consent.

Professionally, as a Conveyancer I would be crucified for giving my Clients telephone number to the other party in the transaction - client confidentiality and all that.

If you are not happy about it - complain.

usually its only the agent you are buying or selling with that would have access to this and the number should only go out to those immediately involved. its rare for a phone number to be given though.

these days agents email a MoS out or many dont bother as long as solicitors in touch.

  • Thx for the posts, I understand Silvercars point about getting things done but thats the EA's job and why I'm paying him. I shall be talking to this other EA who listed my home no. tomorrow and telling her what I think of it.

I just wondered if any other EA's had done it?

I haven't heard of this before and I would make sure you let the EA know you aren't happy the way they did this without at least getting your consent.

just a thought, it might have been prepared by the office junior. really the branch manager should take responsibility and tell you what he will do to sort it out. maybe a note to say which number to contact you on and not home phone.
