Transferring deposits

Hi everyone,

I have been renting my house now for 4 years and the landlord has decided to change agents. I wrote to the agent to ask that m deposit be returned so I can proceed with the new lease etc with the new agents and they have told me that are transferring it.

Can they do this? I was under the impression that the new scheme only allowed forvitvto be returned to the tenet or the landlord after a court has decided that he has a right to keep part or all of it.

When I moved in couldn't ge through the credit check so put down 2 months plus £200 on the promise that after 12 months if all was ok I could have the extra month and £100 back. Which they keep ignoring.

I would rather that money was in my isa than in there accounts and have no reason to keep such a large dep.

    You do not need to contact the agents for this, and you do not need to get a new contract.
    Your relation is with your landlord, he is responsible for the deposit, and him deciding to change agent has no impact on you.

    This sounds like a deposit to me, so it should have been protected into a scheme.
    Have you got receipts and written documents confirming your claim?
  • All I have is the amount stated on the original lease, which after 12 months was nve renewed. Oh I'm in England.
