Credit card deposit refund

Hello all..

I made a purchase of a fitted bedroom but only paid the deposit.

I then changed my mind and within the 7 day cooling off period.

The company are refusing to give back the refund. Although legally I no I'm completely able to get a 100% Refund.

Can I claim with MasterCard and get them to claim it back??

Any advice most welcome!

    How did you make the purchase - online? in store ? or did a salesman come to your house ?

    This will affect your legal rights to a cooling off period (although the seller can always provide more than the legal minimum - is that the case here)

    Please can you clarify why you believe you are entitled to a full refund.

    We signed the form and gave the deposit (MasterCard)

    3 days later we changed our mind. We felt that we were railroaded into the decision. This was within the 7 day cooling off period.

    In the contract it says we are entitled to a refund if we cancel within 7 days. We did that. In wrighting. At there office.

    They are refusing to pay. Saying refund is not for any deposit. But how can you have a full refund that isn't the deposit within the cooling off period!!!

    The consumer rights say we are entitled to a full refund. To house callers as long as we cancel within 7 days.

    Any advice? Can I get MasterCard to chase it??

    The card issuer is liable for any breach of contract jointly with the retailer so if you could take legal action against the retailer, you can take action against the card issuer instead or as well. If the contract says you can cancel in 7 days and get a full refund, it should be a pretty straightforward case.

    In practice the card issuers are slow and very reluctant to admit their liabilities, and the courts will have expected you to have put some effort into resolving the problem with the retailer first.

    Do you have legal cover with your house insurance or trade union membership? Use that if you can, otherwise send a recorded delivery letter to the firm clearly pointing out your claim.

    If that doesn't work, contact the card issuer, but you will have to be persistent.
