Hi and welcome
Yes you can, you do not pursue the DM company though and still pursue the business who sold you the account.
Please be aware they may use the refund towards the arrears, even if a payment plan is in place, anything remaining should come back to you plus interest.
But this may differ from one company to the other, they don't always work the same way.
