:j Just had confirmation of success claiming £1050 from halifax, sent questionnaire off in December and replied today :j.
I sent same questionnaire to Capital One at same time but got refused so going to appeal now.
Claimed on grounds of preexisting condition which capital one say they had no duty to ask about. Is this right?

I understand that this is correct, as they did not tend to go through med questions as such, but still if you did have pre med conditions at the time of taking out the policy, you would not have been able to make a successful claim on that particular condition, they should though take this into consideration because for that matter it was worthless to you.

Thanks di, I wasn't sure who the responsibilty lay with for disclosing medical conditions.But if halifax paid out then it might be worth appealing.0
