Cheeky Ebay Seller

OK, heres the story my brother, (I say my brother,) brought his third item from Ebay, which was FIFA 07, on the 7th of Feb. Two weeks later my brother filed a complaint.
So the seller finally decided to post the item yesterday (23rd Feb) my brother finally receives the item today (24th Feb) and we find the manual is missing and the disc shows signs of use, even tho the item was meant to be new. Worse of all we find the seller wrote a love letter on the back.

Sorry, am I missing something here, what bad weather, what he means the snow, sorry thats no excuse, even if it was because of the snow, the item should have arrived sooner than it did.
I brought tons of items from America after the 7th of Feb and they arrived before this.
Any advice on what to do.

given how little ebay do about scammers and fraudsters, dont hold your breath0

If you leave them neg feedback, their feedback score will reduce drastically as they only have a feedback score of 2, ie their score will be about 50% which will put other buyers off but then again your brother only has 2 feedback as well and guarenteed they will do the same to you which isn't fair so I wouldn't bother as they probably won't be leaving your brother any good feedback. If they do leave a neg feedback then just do the same to them - sounds abit petty but so are they from reading what they wrote to your brother.0

What a bizarre message. Seller seems to be contradicting himself.
By the way, any chance you could make the picture smaller?My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

you should file a SNAD (significantly not as described). Attach the picture. Also, pull the seller's details from ebay. They will know you have done this as they will receive your details too. He will worry (hopefully) when ebay contact him and they will don't worry. I did the same when something similar happened to me.0 -
What do they mean it didn't reach you first time... How many times did they send it!?!?
I presume they left the manual out and used the disc on purpose.
Don't think you can file two disputes over the same item. Maybe you can add to the original dispute if you left it open.0 -

Thats what I don't understand.
If he or she sent the item and it did not reach my brother the first time and he or she got the item back. How did he or she expect to receive the item back this time if didn't manage to reach my brother again this time, because there is no senders address anywhere.0 -
well he had a fb score of 2 and he only registered on the 21st of january 2007.
all i can say is, there is no way would i have bought off him. esp for an item such as software.Get some gorm.0 -
Its a classic case of the seller being too busy or too lazy to post it in the first place. It happens.
But like you say the condition is bad so on that basis I would file a dispute and demand a refund.
I dont normally ask the status of postage on items until after two weeks, and even then I give sellers a further week to post it. It is only ebay afterall... not some mail order business.0 -

I guess a polite email to them first may have been the best thing in case they had genuinely forgotten it. They obviously got annoyed and defensive that you'd filed a dispute. Although if it had been me I would have apologised profusely, sent it asap, therefore putting an end to it. Some people are just so childish.0
