Do i need to ask for a supersession as the circumstances have changed0

Could maybe the resson you have been refused is that you daughters condition suddenly got so much worse at around almost exactly the same time as you started an appeal???? Bit bizarre that

Jake and spam free how sad to even think like that.
I would give anything for my daughter not to be heartbroken right now as she is yet again missing out on a friends sleepover
Her epilepsy specialist feels things have gotten so much worse this summer as puberty has arrived (apparently this is fairly common) Think this is a far more likely coincidence than me being a benefit cheat but hey think what you like.0 -
Hormones can affect epilepsy. My MIL had epilepsy as a child, but 'grew out' of it and didn't have a fit for over two decades. When she went through the menopause, she started to fit again. She had an early menopause at the age of 37, but she still has occasional fits 35 years later. It is mostly controlled by her medication, but once or twice a year she ends up in hospital because of her epilepsy.0

Anj S - I wouldn't take it personally - but many opinions can be based on the actions of others (not yours) that affect judgement.
Eg one of my daughters friends has "epiliepsy" - she gets DLA and carers allowance so she doesn't have to work. They went on a school trip for a week (in my DD dorm) - no fits at all the entire week.
She has slept at my home on many occasions - I know she also reports night time vomiting - so I was very very concerned as I have no experience (unlike yourself her mother seems to think it is fine to sleep over).
Gosh I never slept a wink the first few times (didn't want to use the baby monitor as girls need privacy on a sleepover) but I was up and down every 20 mins.
not one - not on any sleepover
I can't say if her claim is valid - I have a 1% knowledge, but I can say that in the 1% of time we have spent with her - she has not once had a fit, nor has at school, nor when away with the school.
It tends to make people sceptical when co-indidences occur - but very unfair to tar all with the same brush IMO.0 -
Thank you for that princessdon, agree im sure there are people who would cheat, but as you say not fair to tar everyone with that brush0

Well got a call back today and the guy confirmed that the paperwork had now gone to tribunal. He said the additional i had provided had also been sent. I asked if the tribunal would consider the new information on how my daughters condition had changed or could they only look at information that was about how she was at the time of the original decision, he said he didnt know???? H then told me he wasnt a decision maker just one of their admin. i explained that i had been promised a call back from a DM by the helpline and he Apologised and said that the helpline didnt always understand how things work but he would get a DM to call me. Well less that an hour later I got a call from a decsion maker who was lovely. I asked her directly if it would be better for me to make a new application or even a supersession application as the situation has deterioated so much since the original application. She told me i was very well informed, and joked i should work for them. ( my knowledge is all thanks to you guys on here). She said absolutelythe tribunal could only consider how my daughter was up to the date of the original decision and she could see from the notes that the situation has changed and therefore she advised me a new applicafion may be the way forward, she also gave me some tips on what to include. She said i should leave the current application going to appeal as if was overturned there would then be back pay.
Feel more positive now, as surely a child who is having upward of 6 seizures a night needs care above the average teenager!, going to work on a new application this weekend, wish me luck
Thanks again for all your help
