Joint account help please!!!

Not sure if this is in the right section so apologies if not.
My husband and I separated last month and he agreed to pay his half of the mortgage until his name was removed from the mortgage. However he has now announced that he will not be paying his half, which is due on 1st March and that I can see him in court for the money.
The mortgage is taken from our joint bank account which is currently in credit however if his payment is not made the account will go overdrawn. My question is can I then remove myself from the account and leave him liable for the outstanding money? Or should I try to remove myself whilst the account is still in credit? The account is with HSBC.
Any help would be appreciated.

You will not be able to remove yourself from the account if it is overdrawn.
In fact unless he agrees to sign to the effect that he is happy for your name to come off then it won't happen either.
Do you have any written agreement confirming that he has agreed to pay half of the mortgage and do you have any kids?
Do you have enough income to be able to continue with present mortgage?
If the bank won't agree to an overdraft on the account (and without your husband's agreement this might be difficult) then tell the bank there is a dispute and that you want it blocked. This will prevent all transactions on the account - both in and out. Then contact your mortgage lender explaining the situation and ask for some breathing space. If your mortgage is up to date this should not be a problem.
Finally get proper legal advice and quickly especially if kids are involved.0 -
Why not go to your bank, explain the situation and your fears and ask them what would be the best way to proceed. Keeping them informed could avoid any future problems hopefully.Speak your truth quietly and clearly;and listen to others,even to the dull and ignorant,they too have their story. Avoid loud and agressive persons, they are vexations to the spirit0
