PPI Claim Newbie...Help

What do you think my chances are folks?
I have sent my questionnaire off to Capital Bank(part of BOS) on Wednesday fingers crossed.
I had a loan with capital bank in 2000 - this was consolidating a previous loan with them (that did not have ppi on it) and the sales agent on the telephone took it upon herslf to add ppi on to the new loan. (i have had lots of credit cards, loans, catalogues, stores card in the past and always ensured that ppi was never added). When i checked the paperwork months later i was furious that she added it on - but in a depersate situation at the time and i was unable to cancel the ppi.
Anyway 2 years later i defaulted on loan and it was transfered to a the Blair, Oliver and Scott - the bank of scotland's internal debt collection agency. Through a payment plan i repaid all the debt which included the ppi and interest.
The loan was for £9000,
the PPI was £2762.10
the interest at the 12.7%
the term was 60 months so it should of finished aug 2005 but under the payment plan this finished mar 2008.
Capital Bank were very good and sent me my T and C the day after requesting it.
Do they usually payout when you have defaulted???:o

who do you claim the ppi off though...the lender or debt collector?
my lender was rbs and i have the loan agreement but they wont accept the agreement number and have sent a ppi claim form, the loan was in 2001 and ran for five years.

You go to the who you purchased the loan from, why wont they accept the agreement number?.0 -
I dont know, they just say a loan agreement number isn't an account number but when the debt collectors took it on, all correspondence was done using that number, although when i rang them last week the guy said it must be the sort code and account number in one and processed the claim. A week later i have a letter saying they have no record of that account and i should fill in a long winded ppi claim form and copy the loan agreement ( which i do have ). They also said i could apply for a SAR, but with the info i've given them they have no records. Is there any point to a SAR in that case? Or would i get information from them thats tied to my address regarding them? The ppi was £2500 on a 5k loan.

I would do a Sar you need the agreement number.
You could go into the RBS and ask them to find you, the loan agreement number is the number you use for a mis sell claim, have you tried the debt collector ? see if they have loan account number.0 -
The copy of the loan agreement i have is from the debt collector, it is the original one i had in the beginning from RBS. As far as im concerned the agreement number is the account number. I did try an RBS branch but they were most unhelpful and said they dont keep information like that and they couldnt help me, i think im more inclined to fill in the claim form and then they'll have what i've got. if i applied for the sar, as the debt was past to debt collectors, does that mean RBS wouldn't have the details on record?0

You will get all info RBS have on you if you do the Sar,the info may have been archived due to the year.
If you have reasons for mis sell then just put a claim in with copies of any info you have, the agreement cannot be refuted so i would think they have to look at this.0 -
I'll fill the form in that they provided, i dont think i need anything other than this loan agreement for them to trace it. I hope to get some joy as i was made to feel that i wouldnt get the loan unless i took the cover and wasnt asked if i could cover the payments in the event of unemployment/sickness etc. The loan was done over the phone, i lost my job and couldn't claim on it as i had to give them an unemployment benefit reference number i think, which i couldn't do as i was unable to sign on because my wife earned too much. I ended up paying it back early after it got passed to the debt collectors anyway.

Put in the claim form that this loan was front loaded, this was a loan on the loan paid back over the term with interest this is the most upheld of all ppi mis sells.
put that you could not claim on the ppi for the reason you stated in your post.

Sorry for the long wait with the update, but this week i finally had a cheque for £4000. First attempt to claim took eight weeks then recieved a letter to say they didnt have any details for the name, then i could see that they'd spelled it wrong....how silly! I then sent a copy of original loan agreement and they made me wait another 8 weeks before settling. Even though they took the michael, 16 weeks waiting for £4000 didn't hurt one bit!
