Hi can anybody help me with my question. i have 2 post within the same pct dept. i am a band 5 in one post and a band 6 in the other. My band 5 has gone out on an offer of redundancy but my band 6 post is not at risk. i have taken the offer for 19yrs on my band 5 but was told today that if my 2nd job as a band 6 goes to tender I will not be offered the 6 years I have worked as i have already taken redundancy from the NHS? The term and conditions state in section 16 -- 16.2? reckonable pay that offers on service cannot be paid again. i am arguing that i have 2 posts and 2 contracts so how can this be, where would my 6 years service go as i have not left etc. i have spoken to ACAS and they are not sure this is right. Any ideas??

16.6 The following employment will not count as reckonable service:
employment that has been taken into account for the purposes of a
previous redundancy, or loss of office payment by an NHS employer;
where the employee has previously been given pension benefits, any
employment that has been taken into account for the purposes of
those pension benefits.0
