How can I demand my P45 from agency?

Hi, I am awaiting a P45 from an old agency I worked for up until christmas, they stopped giving me work after I complained about my shifts being cancelled on the morning I was due to start when they were giving them to other drivers(I know they were doing this as I know someone who works in the office who confirmed) so I requested my P45 3 weeks ago, I asked why it wasn't done yet last week and the guy said "next week". So here I am a week later and still no P45 :mad: They were god awful people to work for anyway, is there anyone I can complain to or threaten with if they don't comply with my request? If I have to go and see him face to face I am likely gonna smack the !!!!!! head in to next week!
Payroll is weekly so should of been issued by now surely?

    HMRC is the ones you would report them to for not giving you your P45

    Generally companies dont want HMRC crawling all over them and so mentioning your intention to raise the issue with them is enough to prompt action

    Have you handed in your notice? Give them your notice and ask them for your P45 and outstanding holiday pay.

  • I have had an email from the office saying it has not been done and it will be done next week :mad: I could flip out I knew they would do this, yet more fuel to the fire that agency's are scum. I hate them all.
    I have asked why it is not done after two requests and I shall be involving HMRC if this is not resolved sharpish or words to that effect.
    Shall I just ring HMRC tomorrow anyway? I honestly doubt they will bother they treat their drivers like rubbish unless you jump to their tune and this will be another one of their arrogant "we can do what we want" crusades against us mere drivers. Who by the way pay for their sports cars lining up the car park.

    No, I didnt see the point as they clearly had no intention ofgiving me any work. Funny thing is, I have been available every weekend from the start of the year and the firm I was in at weekends cant get the staff so they are getting stobarts in to sub the work !!!!!! surely I would of been cheaper then paying them lot.

    The point is that unless you write and say "I am terminating my employment with you", then there is no need for them to issue a P45.

    As it's an agency they are likely to be used to people not working for them for a matter of weeks or months and then returning to carry out another assignment.

    Write to them and confirm the termination of your contract with them and that you want any outstanding holiday pay and your P45.

    I understand that but they have said they will sort it for over 3 weeks now so as I said what is the point? If I do this today then how long do I give them?
  • I have now done this by the way, just didn't see the point. I can't see them wanting to pay me any holiday pay which I had forgot about so will be interesting with what they come back with.

    Surely the agency should have told the OP this rather than promising a P45 that hasn't materialised?
