Holiday Pay

Hello,

I have just been for an interview, it is temp till Jan part time about 25 hours, more if they need me!
I was told that they would not be paying any holiday pay at all.
Is this correct?

    No, you are legally entitled to 28 days (pro rata) yer year.

    Yup, unless they make you aware that a proportion of your wage is holiday pay, but this is only usually for very short term contracts. And your contract must state what % of your wage accounts for holiday pay.

    Where is the job?

    If you accept the job, maybe you could point them in the direction of the ACAS website, which describes the legalities of holiday pay.

    Hi Lottie,

    It is in an Estate Agents, she said I could do extra hours if I wanted time off, dont think I would want to be put in the position of telling them about ACAS though if I get it

    Is it via a recruitment agency? There's been threads in the past where some agencies pay a higher hourly rate but don't pay when agency worker takes time off.

    Hi Sam - Well it's entirely up to yourself. At the end of the day, they are breaking the law by not giving their staff (temp or otherwise) holiday pay, BUT if you are happy to work without it and don't want to "rock the boat" by asking for it, then you are entitled to do that.

    Personally tho, I think this is a pretty bad state of affairs and wouldn't want to work for a company that wouldn't give me what I was entitled to.

    This is true, but again, details fo this must be specified in your contract of work from the agency. Also I wouldn't say this was a common way of doing things, I temped for 3 years and never once encountered an agency who paid me my hol pay in my wage.

    Think it was one particular agency lottie that's come up in thread/s before but I can't remember which one.:cool:

    Hi All,

    Its not through an agency it is direct with the employer, who advertised the job via the Jobcentre website.
    I agree with you Lottie I did feel a bit uncomfortable and suprised when I was told no holiday pay, she did say she did think the person on maternity would probably not return.

    If it is a contracted time then I would accept the job, work there for a few months and then show them their duty for holiday pay...or wait until the end of the contract and show them....nice little windfall (may have to go through a tribunal!)
