ITV Tonight Show - Re-claiming Bank Charges!

Congratulations on your tv slot on Tonight with Trevor Mcdonald. Totally brilliant. I do check your web site regularly and although i wanted to re claim charges i was scared ...until tonights show that is! I have copied your templates and already have letters printed off to post to the banks tomorrow morning.
I do have a query though and hope you or any chat memebers can answer!
If i have banks accounts that over years have accumulated charges upon charges wich result in debt and now am not able to use the accounts, can i still claim a cheque from the banks for charges back to me.??? I know banks dont make us spend but they do make it hard for people like myself to get out of the debt trap by imposing charges upon charges.
Also another point is i do now have a current account with another bank wich runs well and am not in debt with, can i keep this account as my parrachute account as im not claming from my exsisting bank??

if your not claiming on your existing account then use that as your parachute account.
the usual answer to your question is that if your claiming for an account which still has a debt on it then yes the bank is more than likely to want any debt paid off first and foremost...BUT i'm sure i have read somewhere that if your claim goes to court then you do have the right to request it paid directly to you.....this might even be right up to the point of judgement (if it gets that far) where it allows you to say how you want it paying.
even if your not allowed to claim back directly to yourself surely it would still be a good thing to reduce your debt

Thank you for your reply...its all so much of a mine field eh! very scary battling against the greedy banks ...i paid my mortgage today which has never been in arrears, the damn bloke on the phone took 2 months payment instead of 1 month payment from my debit card, i called my bank and they said i have to chase the mortgage company directly to give me the money back that they took in error... mmmm another 2 weeks i suppose before they pay it back to me....perhaps i should charge them a fee!!:T This site is great! just checked my internet banking this moring and because of the mortgage taking 2 payments rather than 1, im now waiting for a refund but on my internet banking its now put me overdrawn BECAUSE the mortgage company have stolen 1 months extra payment from my debit card! now nat west will charge me for going overdrawn at no fault of my own! whos fault is it ,, i know its not mine!! had they not taken the extra payment THEIR MISTAKE! i knew id have enough money in my account to NOT GO OVERDRAWN!:T This site is great!
