The following letter arrived today for my son who no longer lives here - yes it will be ignored. He was threatened with a Tribunal about a year ago, nothing happened.

(He supposedly did some damage to a car a couple of years ago with a motorbike, insurance isn't required in New Zealand).

Debt Collectors Ltd acts for Mongface Business Solutions as its duly authorised commercial agent.

We are instructed that you are presently indebted to Mongface Business Solutions in an amount of $701.25 plus any accrued interest (“the Debt”), in relation to the above account as at today's date.

Without prejudice to the rights of Mongface Business Solutions under its agreement with you, Mongface Business Solutions is willing to accept a reduced amount of $620.34, as full and final satisfaction of your debt liability on this account, subject to and conditional upon the following terms:

1. Your acceptance of this offer constitutes your acknowledgment of indebtedness to Mongface Business Solutions for the full amount of the Debt;
2. Payment of the amount of $620.34 must be received by Debt Collectors as cleared funds, no later than close of business on (14 days hence);
3. Should there be any default or delay whatsoever in the punctual payment of the reduced settlement amount then, Mongface Business Solutions will be at liberty to:
a) commence or continue legal action against you, without further notice, to recover the balance of the Debt together with all moneys, charges, interest and legal costs which are payable, or have been incurred or will be incurred under your Agreement with Mongface Business Solutions;
b) charge interest on the outstanding balance of the Debt, at an annual percentage rate up to, but not exceeding, the annual percentage rate specified under your Agreement with Mongface Business solutions on each and every occasion that an instalment(s) is due but not paid, and calculated for the period of time that the instalment(s) or balance of the Debt remains unpaid;
4. This indulgence to allow you to repay your indebtedness to Mongface Business Solutions by paying the reduced settlement amount intead of the full outstanding amount, in the manner and at the time set out above, is given without prejudice to Mongface Business Solutions's rights to recover the whole balance of the Debt, including interets and other moneys, owing and payable by you under your Agreement with Mongface Businesses Solutions if you fail, neglect or refuse to pay the reduced settlement amount as specified; and
5. It is expressly acknowledged and agrred that these arrangments will not and do not compromise Mongface Business Solutions rights against you under the above account in any way whatsoever.

If payment of $620.34 is received in cleared funds by (14 days hence), the payment will be accepted by Mongface Business Solutions in full and final satisfaction of your indebtedness in respect of the above account. If this account has been default listed then, the relevant Credit Reporting Agency will be advised that your liability in this matter has been satisfied.

If payment is not received in accordance with this letter, you remain indebted to us for the full outstanding amount due and payable under this account.
