Bailiff from Task Enforcement...Terrible day.

    That would be par for the course. Bailiffs are legalised robbers, if you let them be. A shame you had no previous experience of them, as you would have known not to even entertain them as your car couldn't be seized.

    I am a retired policeman and have just written a paper on the criminal aspects of bailiff behaviour which is on Legal Beagles. If you car is on HP, the bailiff cannot seize it and he will know that he cannot seize it. If he says he can seize it regardless, he is committing the offence of Fraud by False Misrepresentation (Section 2(1), Fraud Act 2006). If he does seize it, he commits the offence of Theft (Section 1, Theft Act 1968). If he then tries to sell it, he risks prosecution for Handling Stolen Goods (Section 22, Theft Act 1968). As for him threatening to call the police, that is misrepresentation of his authority as a bailiff. Ring and ask him what court issued his Bailiff Certificate, then go to the Ministry of Justice website and download a Form 4 which, once completed, is sent to the court that issued the bailiff's certificate. Misrepresentation of authority is frowned upon and if found to be justified, the bailiff could suffer revocation of his certificate, which means he is out of a job.

    If only you'd known the truth ...you could have taken him up on that offer and made him look like the ahole he clearly is.:)
    The only one breaking the law in this scenario was the bailiff !:mad:
  • Guess what guys!

    I overturned both cases and got ALL of the money back...except for one small glitch - funds were sent back to a credit card that does not belong to me, eek.
