HELP! Invoice from Lettering Agent after I get deposit back.

    Seriously, if you got legal advice through work and they said the agent was just trying their luck then I'd ignore them. Don't even pick up the phone.

    I agree with Yorkie et al . Using the fact that you have your deposit back and you don't agree to the work is probably not the best line. Follow DVardysShadow's suggestion

    How did it fall down? Were you particualrly rough with the curtains? Were the fixings poor as DVS has suggested?

    My hall curtain pole has fallen down 3 times in 2 years. I hadn't done anything to cause it to fall down - I was out at work each time.

    When I finally took the trouble (!) to investigate why it was so unreliable, I found a broken rawl plug and short screw which were in no way adequate to hold up the pole and curtain. Faulty initial installation by someone else rather than my negligence.

    Don't write, or phone. Don't acknowledge the debt at all. You don't owe them anything.

  • It wasn't flush to the wall when I moved in. It fell down at 3am when I was sleeping - scared the heck out of me. Old house and the brick work had turned to dust around it. Nail was short and rawl plug was cemented onto it, as if it had been bodged before. I phoned them as soon as it happened (well once they were open ha ha). Now they have sent me the bill direct fro the workman.
    Don't want to get into more trouble by ignoring it, but it won't go against my credit or anything surely?

    They could go as far as getting a CCJ and if you settled within 28 or 30 days [whichever it is], and it would not go on your credit record.

    Given your description of how it was when it fell, it is not your fault. Write back to the Agent, say the pole fell at 3am, describe the fixing as you have here, state that you consider that the pole fell because the fixing was not fit for purpose, state that you do not consider it your responsibility to pay. And state that you consider the matter closed.

    Take a copy of the bill for your records and post the original back with your letter. Keep a copy of your letter.

    Unless you have in anyway offered anything or accepted responsibility in writing already, in which case say so and we can advise accordingly.

  • I haven't actually accepted liability. I rang them and explained what happened asap. I thought I had a good relationship with my estate agent and when he asked if I could put it back up and I said no he said "oh, I'll just send a handyman round and charge you £10 when you move out". I accepted this as it was quite a minor charge and I'd probably have give a friend that anyway to do it.
    When I gave them my forwarding address he did mention it and again confirmed the £10.
    When they returned the deposit they said "oh, LL is sorting out the curtain pole" which I took to mean that that her father was sorting it free of charge.
    I'm soooo angry, I could have found someone to put up a flipping curtain pole for less then £48 if they'd bothered to ask me rather than just flipping well ordering a professional. ARGH!! No letter writting tonight too irate to write cohesively. Given that the bill was dated 03/03/12 they obviously had time to cme up with a game plan so I'll take my time now.

    As you have already offered something, I suppose you should or could add to your letter something along the lines "For the sake of peace, without accepting liablility and without prejudice I am prepared to offer £10 as previously discussed in full and final settlement of this matter. Your written acceptance is required."

    But do make it very clear that you consider that the curtain rail fixing was not fit for purpose.
