job offer whilst being made redundant

Hi, My company has just placed most staff on 90 days consulatation notice and basically are making redundancies which they state are positions and not individuals.


If you are on the list of being made redundant and you are successful in a job application elsewhere can you still claim redundancy payment as the only reason you have changed job is due to the situation?

I know it sounds a stupid question but i had no intentions of changing job, as a result of redundancy which i have to serve 3 months notice, i have had to look elsewhere and with reduced pay, also i may risk losing this job due to the notice period.

    if you leave early you resign and lose entitlement. Some employers MAY let you go early with a payout but there is no legal obligation to do so.

    I was made redundant a couple of years ago and had a job offer within a couple of weeks. HR asked to see proof that I had applied for the job after being informed of redundancy (i.e. so they could tell I hadn't been applying already) and then still gave me my redundancy payment. I had to sign something to say I wouldn't sue the company.

    I think some companies give you the payout even if you leave early so that you won't have a constructive dismissal claim. I guess that if you resigned you could claim you had to because they were making you redundant.

    It would be rare for a Company to pay redundancy pay to anyone leaving during consultation.

    If your post is selected for redundancy at the end of the consultation and are on notice, then you may well have a case to claim redundancy, particularly the closer you get to your termination date.

    The only circumstances where you are legally entitled to a redundancy payment if you leave early is when you are under notice of redundancy, and in your statutory notice period, and you give written counter-notice to leave on an earlier date.
