Am I Eligible to Claim?l

Hello there

Not sure of whether or not I should try to claim, so any advice would be gratefully received.

I took out a Capital One credit card back in late 1997 and this was my first and has been my only credit card to date. I have been paying PPI (or Credit Care Insurance as it appeared on an early invoice I have) since the card became active in late '97.

My card application was by means of a postal application form and, although unfortunately I didn't keep a copy of the actual application form, I do have other paperwork I was sent at the time. These included the initial bumpf I must have seen about the card and in amongst this is a leaflet about PPI. The leaflet tells you about the cover, that it is a simple, affordable and sensible way of maintaining your card payments and it also stated that you have 30 days to cancel the cover without charge. Once the card arrived, I also received a second leaflet asking if I had applied for Capital One Card Payment Protection and detailing the benefits of having it.
As PPI appears from the outset I'm presuming that I must have requested it or it could have been one of those tick box jobs - I don't know.

At the time I applied right up to a year ago I was a Civil Servant of 20+ years service and had redundancy and illness cover. I also, as part of my mortgage, had income protection cover in case of redundancy or ill health as well. So, very retrospectively, I realise that I never really needed PPI at all. I didn't consider what PPI was and, aside from the two leaflets, never had any other info or any other contact with Capital One about this.

Sorry for the long note, but my question is a simple one. Am I, bearing in mind that I did have these leaflets, eligible to claim back and for what period would any claim cover?

    From what you say, it seems that nobody advised you, you were given documentation that showed it was optional, it appeared on your statements each month for fourteen or fifteen years but you did not query it.

    I would say it was not missold but I would probably just timebar you if I was dealing with the complaint.

    There is nothing wrong with having PPI. You cant just complain because you bought it. The whole issue comes down to how it was sold and set up. You dont appear to have been sold it. So, that eliminates a significant number of complaint areas.

    So, the bottom line is, if you were to complain about it being mis-sold to you, what would your complaint reasons be?

    Did you go on to make a claim for missold ppi as I have a feeling that is exactly my situation too and wondered what your next move was...??
