paid out twice by lloyds

hi to all
i had a ppi claim refunded by lloyds back in september,on the claim form i asked them to consider one particular claim but then asked them to consider any other loans and cards linked to my account,i got a refund paid directly into my bank then a week or so later i got a cheque for the same amount ,i presumed that i had been paid out for another card or loan ,now last week (6 months after the pay out) lloyds rang me to say that the second payout was infact a mistake and am i in a position to pay the money back ,the problem is that i have spent the money and don't have it to pay back can they expect it after 6 mnths ??

now the other part to this is, i then before, i did my own claim had given a loan account number to the claims advisory group to claim on my behalf i had a letter from the bank saying they were paying out on this claim in november ,yet i still havn't received the money which happens to be the same amount that they overpaid me can they keep this as the over payment because obviously the claims advisory are onto me constantly for their cut.
any help gratefully received
thank you:)

Oh dear, it sounds like you are in a difficult position :( sometimes banks can make mistakes and pay out twice for the same complaint and they are entitled to ask for this back. You should have questioned the double payment BEFORE spending it, especially as it sounds like it was exactly the same amount, that should have raised your suspicions and made you query it. Now not only do you owe the bank but you have the claims company on your back for their cut :(:(
I don't know what to suggest here as you are in a tight spot I'm afraid, any suggestions folks

I got a cheque for the wrong amount, but i realised it was too much so i sent it back, if i had cashed it, it could have been construed as fraud.
