Please help with my parking ticket problem

I parked in a Council car park on Friday 10th February 2012 at 7.20am in the morning. It had been snowing the night before and the bay where I parked had not been gritted and was covered in snow. On returning to my car at 5.30pm I had a parking ticket stating that I had parked outside the bay. The ticket was issued at 12.20pm by which time the snow had melted.

I emailed an appeal and today received the following reply:

Dear Sir/Madam,
Penalty Charge Notice:
Date of Contravention: 10/02/2012 VRM: CE54ULB
I refer to your correspondence concerning the above Penalty Charge Notice (PCN) and apologise for the delay in replying.

The Penalty Charge Notice was issued as the vehicle was observed on YORK CLOSE CAR PARK not parked correctly within the markings of a bay or space.

The notice board adjacent to the pay & display machine clearly states it is an offence to park outside the marked bays. When using parking bays you must make sure your car is fully within the parking bay before you leave it. If it is beyond the end of a bay, straddling two bays, or obstructing the clearway, you may get a ticket even if you have paid to park, or have a valid permit allowing you to park.

I note the content of your letter but would advise that the officers do not issue notices to vehicles for this contravention when there has been a covering of snow that would obscure the markings. On this occasion I am satisfied that there was no snow overnight on 9th February 2012 that would have covered the markings for parking on the morning of 10th February 2012 but then be clear by midday.

I am satisfied that the notice was correctly issued and there are no grounds to cancel the charge. The Council therefore requests that you make settlement at the discounted rate of £30.00, which is payable for a further period of 14 days from the date of this correspondence. If payment is not received by 27th March 2012 the discount will no longer apply and the full amount of £60.00 will be due.

The Council regrets that representations cannot be accepted or discussed by telephone, nor will the decision be overturned.
The discounted period will not be extended if further r
representations are received.

I have no photographic evidence of the snow as I did not think to photohttpthe car when I parked and when I returned to the car the snow had melted.

I am furious that they are lying about the fact it did not snow.

I would appreciate any help with this.

  • Went into CCTV today who told me they only keep it for one month and have deleted all CCTV for 10th February!!! Grrrr - Should I take this all the way to appeal????

    I would. What does your local Met office have to say on the issue?

    Sometimes Councils have the same mentality as the Parking Parasites.

    Here's another idea. Get your local paper interested, they can put out an appeal for anyone who has photographic/video evidence there was snow to contact.

    Went into CCTV today who told me they only keep it for one month and have deleted all CCTV for 10th February!!! Grrrr - Should I take this all the way to appeal????
