Littlewoods Return - item lost/stolen

Hello,

I'm hoping that somebody can help me with this. I have searched the internet and can't quite seem to find the answer to my specific question.

I recently placed an order of some jeans from Littlewoods for my husband. They were too long so I requested a return and, as I have done on numerous occasions, I left the item on my front porch to be collected. When I returned home the item was gone but the courier (who I have since spoken to) tells me that he hadn't collected it. The item has not appeared on my Littlewoods account as returned and Littlewoods have told me that I will be responsible for paying for the item.

Does this have to be the case? And what would happen if it were the other way around and the courier had delivered an item to my front porch that subsequently went missing (or was stolen)?

Thanks for your help.

  • I'm afraid you're on to a loser with this.

You have a duty to ensure the safety of the item until it has been collected by the courier. Leaving it on the porch clearly isn't doing so.

If the courier left the item on the porch when delivering then then you wouldn't have to pay as you had not accepted responsibility for it at that stage.

That being said I have left an item outside the front of my house for collection before & just trusted that the effort it would take someone to steal a large TV stand would put them off!

You have a case - but against the thief, whom you will unlikely ever find unfortunately. Lesson learnt
  • Thanks for the feedback. I definitely won't be leaving anything there anymore :( The whole situation creeps me out a bit as you couldn't see it was there from the street, you'd have to come down to our basement flat's front door
