Wescot phoning daily

Wescot are calling on a daily basis, regarding a credit card debt which I believe could be statute barred. Foolish enough to tell them I would pay an amount monthly during their first call but having realised that it was defaulted in 2005 and I certainly haven't contacted them in the last 5 years (Scotland), I think I am in a position where they cannot touch me. When they call I simply refuse to answer the security questions, now I know they are going to call every day so what should I do? Will I continue to refuse the security questions or should I write? Or shall I let them continue sending demand notices and ignore them?

Send a letter advising them you want your number removing and all communications should in writing.

Also send them a letter saying that the alleged debt is statute barred, providing you haven't paid anything or acknowledged the debt in 5 years as you are in Scotland(6 in the rest of uk) If they continue to hassle go trading standards and the FSA .

They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

i think you have acknowledged the debt yourself already and agreed to repay it, so the time is re-set back to 5 years (Scotland)

    Nope.

Once a debt is statute barred in Scotland, the debt is legally "extinguished". It no longer exists.

Nothing you do can "unbar" it.

Plus in either Scotland or England, phone calls cannot count as acknowledgement. Even if recorded. It has to be acknowledgement in writing signed by the debtor or their appointed representative.

This is what I am thinking, although I offered payment last month, if the debt was already sb'd, then it wouldn't matter as it would have become extinguished. I am 99% certain that I have made no payment or written to them in the last 5 years. I have moved around a bit though, could they use that as a defence for not finding me...although I would have been in the electoral roll all that time.
