Hi,

I have been reading through the forum over the past couple of weeks, as I recieved a parking fine from Total Parking Solutions. The started of by reducing the fine from £90 to £50 and I ignored this.

By the forth letter they are now saying that I owe them £115 and if I don't pay it could effect my credit rating and they will be passing it to their legal department. That the time to respond is now over.

On there letter they it says they are part of the BPA. There are pictures of my car entering and exiting the car park but no picture of the driver. The exiting picture doesn't even look like my car and the back number plate is white not yellow.

Should I continue to ignore or should I respond, if so what should I say?

    Firstly its not a fine, no private company - including this lot - has the statutory power to fine anyone. Its actually a speculative invoice inviting you to pay a charge they have made up for breaching the terms of their 'contract' - the parking conditions where you parked. All they are legally entitled to are their actual losses, which in a free car park is zero. So you actually legally owe them zilch.

    They cannot possibly affect your credit rating without first taking you to court (unlikely), winning (extremely unlikely) and you still refusing to pay up.

    Continue to ignore, you owe them nothing.

    They are just going down a formulaic, well trodden path, which only leads in two directions.

    Either you take their utter drivel seriously, and believe all the lies they tell you, and hand over some money to them (not recommended)

    or,

    You simply laugh at their pathetic attempts to con you and totally ignore them, whereupon they will realise you are NOT a mug and will give up and clear off, never to return.

    Which of those alternatives you choose is entirely up to you. I know which I would choose, but for all I know you have more money than sense, Sarah. :rotfl::rotfl::rotfl:
  • Thank you I am just starting to worry a bit. I am unsure if it is this company or not but come company keeps phoning my house and asking me for and then hanging up if I come to the phone or if someone ask who it is. This has only started happened in the past couple of week since the imposed thise "fine" on me.

    It has now happened 6 time. When I try to call back i can't.

    I'd report that to your phone provider. Log the time and dates of the calls.

    It could be them, though unlikely as how would they have your number?

    What is more likely is that you are on the call list of some company or organisation which is trying to sell you something. Your number gets auto-dialled by a computer system, but, if you answer and there isn't a free representative to connect the call to, it simply rings off. It is a bit worrying if you don't know how it works as it seems like a malicious caller.

    If it was anything to do with TPS they would pretty certainly speak to you. If they do ring, just tell them you owe them nothing and they must not call you again. Then hang up before they can reply. That usually gives them the idea they are wasting their time.

    And as Manx said its not a bad idea to log the calls just in case.

    You also have to remember that the BPA is not some sort of official regulator, it's just an old-boys club or trade association for the parking "industry".

    Shame, I would suggest responding with payment, but alas it seems the time to respond is over...

    Yes, Sarah, the "BPA" sounds like it is some sort of official body but it isn't. The scammers themselves got together to set it up so it would sound impressive to people who didn't realise that it is completely meaningless.
