    Very easy to guess.

    They asked him and he told them in one of the many times he was telling about the accident.

    If you have a car accident (or are even a witness for a criminal court case as I've been both) they ask you your story loads of times.

    If you tell the same story and it's 100% the same each time, or the details you tell aren't plausible then you are lying.

    When people retell stories they miss bits off or add bits on.
    I'm not cynical I'm realistic :p

    (If a link I give opens pop ups I won't know I don't use windows)

    Unfortunately no such intrigue - my driving licence lists another address I keep. It's certainly no secret. Sorry to disappoint!

    There are some cynical insinuations here - seems a bit depressing to assume that everyone is on a mission to hoodwink.

    It's also sidetracking the point of my question, which was simply to ascertain the best way of getting the responsible party to pay for the damage they caused to my car.

    First thing to find ask them if they are disputing liability what their drivers version of events is. You need to know if they are claiming there simply wasnt an accident or if they claim you moved into their lane etc to decide on the next steps.

    Have you paid for the repairs or just living with the damage for now?

    I've written to their agent to inform them that I will be dealing direct (as instructed) and to request clarification but have not yet had a response.

    Car is still damaged but it isn't one I use often.

    To be able to go to court you will need to have documented losses such as a repair invoice or if you dont want to get it repaired until liability is sorted then you will need a pro forma invoice but this would make claiming loss of use during the repairs more challenging and an optimistic repair timescale would need to be taken.

    Thanks, the advice is appreciated. I understand re documented losses - I'm not looking to claim anything regarding loss of use (I have other cars and this one is still usable in any case).

    I'll wait to see what the third party's representatives come back with regarding liability.

    This sounds a bit strange to me.

    I had an accident in 2007 and my driving licence at the time was listed at my parents address. This didn't affect my insurance company paying out for my claim. I don't think they even asked me for my driving licence. Or if they did, they obviously weren't bothered about the fact the addresses were different.

    I presume that the details you give them in connection with the accident must have flagged something up on the system that made them refuse to cover you. I assume possibly because the area where the accident happened was in a higher risk part of the country than the area of the country they thought you were permanently living?
    Indecision is the key to flexibility :)
