It's been 5 or 6 months and nothing but their letters and phone calls for me. At no time have I ever confirmed my name or address to them when they've phoned. I've just said you've got the wrong number and they've said sorry etc.
Good luck sending a small claims to the address the vehicle is registered too. I don't live there anymore and the property is demolished to it's just an empty site.
Surely they need to provide proof of address (on my part via the recorded conversations etc.) to the small claims court before anything can be issued.
Good luck to you in court!0 -

They are highly unlikely to issue a claim at the best of times. The chances of it are less than one in 10,000 statistically. However, unfortunately, they may be tempted to have a try where post comes back as "addressee moved". Unfortunately a Court will accept a claim sent to the "last known address". The idea is that they can then get a win by default, as you will never see the claim. Not only can they crow about it, but, if your present address links to your former address, it will go on your credit file as a CCJ. It can be removed but it's a more difficult process than facing up to it first time out. They are highly unlikely to issue a claim if they know you are going to fight it as when it is properly defended they will lose.0 -

I have PM'd you, please contact. Since you weren't driving the car at the time, this claim is doomed to failure; but you need to defend it properly, I can help you with that.0 -
So what should I do? Carry on ignoring, or fight it?0

Does post sent to your former address reach you? If it does, then carry on ignoring as if they do issue a claim you will at least get it and be able to defend.0

Yes we go over there to collect it from the post box. There's not a house as we're re building but we still collect the mail.
What's the chances that they'll go to the small claims court?0 -
Probably about 1 in 10,000. And if it did they would lose. So nothing to worry about. I wish they would take me to court but I've never been that lucky.
If you prefer you can bring the matter to a head by writing back to the phoney solicitors stating the claim is denied in its entirety and asking who they are being instructed by, since any further correspondence will be regarded as unlawful harassment and they should either proceed to Court or ensure that no further contact with you is made.0
