Benson for Bed - Refund

Shak2012
Hi, this is my first post on this site although a member for a number of years. Please excuse the length of the post.
- I purchased a bed, mattress and headboard from B4B
- The items were bought and paid for in early January 2012 with delivery later that month.
- I brought them from Bensons for Beds (B4B) situated at a retail park (not internet)
- The full payment was made by credit card (About £1300. £1000 for bed and mattress and £300 for headboard).
I brought my particular bed from B4B and paid over my budget as my wife wanted to get the matching headboard. The sales lady said that the combination was avaiable and so we agreed to buy the bed. However whilst still at the store she said that there seemed to be some issue and an alternative headboard had been added. She assured us that she will make the amendment and deliver the goods we ordered.
However a few days later and well before delivery she called us and said that she could not resolve this and was offering us an alternative headboard. I did not want an alternative (as the next best combination we had seen was in another store and considerably cheaper). After some calls she finally told me that she could not provide what I had agree to pay for. I asked for the entire deal to be cancelled as I wanted the whole package not just the bed and mattress. She said that she would do this within 2 days. However she did not and on the 3rd day she called and told me that she had resolved the issue and was able to provide me with the correct headboard. The agreement we then confirmed was that I would only continue with a transaction for all 3 items if they could be provide and delivered in satisfactory time. The headboard was going to arrive a week later than the bed.
The bed arrived on time but the delivery guys were not able to fix it and the store told us that they could not do anything. Customers services resolved the matter which meant that we had to pay £50 from our own pockets which they would refund in full at a later date.
The head board on 3 occasions was meant to be sent to my address and on each occasion I took of a day to receive it. However the same incorrect headboard that was originally ordered by the sales women was sent to my address. I have been in liaising with both customers services, the store and now there escalated complaint customer service team but have not received my headboard. Also I was sent a cheque £50 but it was in the wrong name. They have promised that they would re-issue this with the correct spelling, however this has not happened and many weeks have passed.
I have been told by B4B that that the headboard is still on order, however this is nothing knew they have said this from the beginning. They also have said that that if I have loss faith, which they appreciate I may have, then I can get a refund ONLY for the headboard. They are not willing to refund me for the bed and take it back as they say it is not faulty or defective.
- I have would like a total refund for the items I purchased and the £50 I paid for the bed assembly.
I think I am entitled to because I made it clear to the store before delivery that I wanted the total package and that if they are not able to provide this then I would cancel my order and go else where. They agree to this and have failed to honour this contract. It appears to me now that they lied to me about the headboard to secure the sale.
What legal rights do I have in demanding a full refund.

Have you unwrapped the bed or began using it?
If not, I fail to see why you cannot reject the order as a whole if they are unable to fulfill the contract.0 -
No I used it, as I had to get rid of my old bed and replace it with the new one because I had no space. Hence why i was willing to pay £50 out of my own pocket for the assembly of the bed. I naively thought that I would have the headboard in a weeks times and all would be good.
Also could I claim under section 75 as I paid by my credit card?
Also i have learnt that there is furniture ombudsmen which B4B are a part of. Has anybody ever used them?0 -
