Accused of fraud/ IUC

    can person x's friend prove it is his money? bank statement etc, is person x's friend on benefits too and this money was being concealed from the JCP not to deduct from entitlement?

    if the above cant be proven the money is not fperson X's that its not money from proceeds of crime, work or other then he's in a spot of bother.

    on a lighter note, if the police cannot prove the money is from prceeds of crime they have to return it. at them moment it can be held because there is suspicion of fraud.

    you have to ask why was this money held for this friend when normal people put it in a savings account current account, or in the home in a safe of out of sight.

    person x's friend should get off his high horse of being angry with person x and take some responsability for not putting it somewhere in his possetion!

    Thats very reassuring that the money will be given back as person X needs to pay him back. His friend will prove its his money no problem as it was paid to him from his pension. Reason why he gave it for safekeeping was out of trust and because his friend is a problem gambler and wanted to make sure he hadn't had easy access to this money. Cheers
  • if friend of person x can prove its his pension and he entrusted person x to manage his money for him (theres better ways of doing this) because he has a gambling problem and is NOT getting any financial reward for doing so, i cant see the JCP taking this anyfurther after IUC.

    person x's friend should go down to the police station with person x with his pension statement and account statement, and request for the cash back as soon as possible on taking the cash back count it up infront of the police, mistakes can be made by the police in returning things like this.

    he should attend the IUC with person x with his documents of proof.

    if you friend wants to help manage this persons money he should really open a post office account, then place his weekly allowance into it and retain his card and be designated person to withdraw his cash on the account, that way he can get his money out for him and not store cash at his home.

    It must have been a fair bit of money for the police to seize it, I guess if they were there on a drugs raid then they would believe it to be ill gotten gains, but they wouldnt have had that suspicion if it were a couple of hundred, plus I dont think they would have informed DWP unless it was quite a large amount.

    I dont know much about benefit fraud but would the police inform the DWP? I mean is it their job to do that? What Im trying to say is benefit fraud is not a police matter, they dont get involved unless someone is refusing to attend and IUC and an arrest is needed, and thats very rare, would they be bothered to actualy phone the benefits office and inform them they believe someone may be commiting fraud?
    not all on benefits are scroungers and don't need to be bullied!

    Under the Proceeds of Crime Act the police will put the information before the Magistrates Court and your friend, or his friend, will have to prove to the Court that it was obtained legally for it to be returned.
    I suppose it will depend on who it is returned to as to what will happen to the benefit.

    not really, if the friend can prove without reasonable doubt that its his by legal gains, the CPS wont run with it to court for it to be clarified if proof was given at the police station.

    as someone posted about the police actually contacting benefits yes they will even if only £1000 is seized, the boarder agency does and informs when going abroad to the DWP if they believe you havent when passing through customs.
