    I'm not sure you do. :) I think chanz4 was possibly referring to the time and resourses that would be allocated, not any 'case fee' that would be chargeable.Any 'case fee' only becomes chargeable if the complaint is passed up the FOS foodchain to an adjudicator, rather than handled by frontline staff, and only one in six cases are currently passed to adjudicator.

    I can't see this case being passed to an adjudicator due to the timescale involved and the OP's contributory negligence.

    Sure, yes, indeed it might not get to an adjudicator. I'm not sure of the make-up of the 5 in 6, but a couple of years back I went to a lecture given by someone from the FOS. He said that people would complain about all sorts of things - insurance premiums being put up, being turned down for credit and other such business decisions as well as complaining before they'd gone through providers' processes.

    The OP perceives unfairness and I do too. I think the outcome is disproportionate to the "wrong doing" by the OP. (And we don't know the extent of wrongdoing - you said earlier that the OP would have been advised that unless the statement said payment would be taken by DD then it wouldn't be, we don't know if this happened. If not, then the OP would have been entitled to rely on the payments being taken.)

    I see negligence, but not contributory negligence which is really a tort concept. Yes, a year is a long time. But I don't see that as being fatal. Normal limitation for a contract claim is 6 years, afterall.

    Anyway I don't want to push the point. As I said, I think the argument is weak. I just wouldn't let it go now.
