barclaycard PPI

Hi, I'm looking for some advice. I sent a letter & the questionaire to Barclaycard to investigate ppi that I have recently noticed I have been paying. I had no idea I had this. I have had the barclaycard since 2009. Anytime I phoned Barclaycard to make payment over the years the person on the other end of the phone tried to sell me insuance which I declined as I has no need for it as I get full pay for 6 months if I am off ill. Anyway I got a responce from Barclaycard advising that they have looked into my complaint & have found out that I applied for the insurance myself online& I chose what type of cover I wanted! I have no knowledge of this & I don't think this is true but have no way of proving this. I have requested that they cancel my insurance immediately as it is £16 per month which i have already been paying for some time. Is it worth while sending a complaint to FOS? Or do I need more evidence first? Any help would be much appreciated:A

    You could ask them for a copy of the paperwork if they have not provided you with them yet, or another way would be to request a SAR (Subject access Request) which may provide details of it being an online purchase.

    With the above SAR letter, you will need to enclose the one off payment of £10 cheque or postal order, they have 40 calendar days to comply.

    However, it is up to you if you want to complain to the FOS right now, sometimes the business will give you another opportunity to write back with further information.

    With online purchases, if it was done that way, it was quite possible an opt out, where it was already added and you had to untick to opt out of it, this is easily missed unfortunately, but still it maybe worth your while to try to get more evidence if your able to and take it from there.

    I normally work on the basis that he who asserts must prove. That doesn't mean the complainant has to produce the evidence themselves but I do need to be able to find something to support their case.

    In this instance, though, it seems to be working the other way. The bank is asserting that they applied for it themselves.

    If that is the case, though, the bank should have some evidence of it. If so, I cannot see why it has not provided it with the response.

    So I would go straight to FOS rather than messing about with a DSAR. It will take some time to get through the system but I think you will stand a good chance and if you win you will get interest either cancelled from your account or, if it is in credit, at 8% simple.
  • Thank you for your help. I am just going to send my complaint to the FOS & hope for the best. I feel pretty confident as I know I did not apply for the insurance myself.
