    I'm ASTOUNDED at how many people on this board think it's ok for them to just pay it back! They shouldn't have STOLEN it in the first place!!!
    When your life is a mess, stop and think what you are doing before bringing more kids into it, it's not fair on them.

    I have now appealed. I hope this thread will be useful to others finding themseveles in a situation similar to mine as it has helped me. This is my last message on this thread. For further developments of the appeal I will be in touch through personal email with those posters who have helped, they know who they are, but I have been warned an appeal can take years so it might be a long wait. All the best to everyone.

    if you'd "forgotten" to tick a box which resulted in no money being paid to you, you'd have soon kicked off about it.

    sorry, but people who BREAK the law should not be afforded sympathy. Maybe we should all just steal and lie our way through life and come to forums for some sympathy?:mad:

  • Well hopefully they can understand people make mistakes and realise that.
    They do know.

    My son who claims carers allowance for me and gets a top up of income support went abroad to get married last year.

    His new wife's mother started with the recurrence of a brain tumour whilst out there so he delayed their return until she had all the tests done.

    Unfortunately neither of us thought to inform benefits that he was staying longer than he was actually allowed to do so.

    Anyway to cut a long story short, compliance came to visit and I explained the situation and as I told the guy what had happened he nodded and said yep easy to forget to do. He told me it would go no further, it would not go to fraud or court at all which it didn't but obviously there would be an over payment to pay back.

    All in all they were more than fair and very understanding and helpful as well.

    So they do know if you are a genuine mistake or someone who is trying to cheat the system.

    I will say that even so we were told it would not go any further it was a very stressful and worrying time, because not just in the eyes of the law but we had done wrong in not informing benefits, simply because we forgot.

    It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)
