Vendor left us with £5K management fees

    Yes Ive been waiting an additional 4 weeks as exchange cannot take place till my solicitor recieves written confirmation that my management fee's are up to date(of course the company got sacked 6 months ago and are refusing to reply). Definatly get in touch with your solicitor.

  • I agree with Richard, being a Conveyancer also. I personally would not exchange Contracts on such a property without having first obtained a written undertaking from the Sellers Solicitor to say that they will discharge any ground rent / management company arrears and any other Vendor related charges.

    Your first stop should be with your Solicitor to ask whether the undertaking was received - if not you do have rights of redress - this would be your legal reps error and they will then have to rectify the matter

  • Im fairly sure they cant chase you for the previous leaseholders contribution debt any more than they could chase you for their credit card replayments.

    You should take legal advice, however the Head Lease/Freeholder should have taken action long before now by putting a charge on the property and issuing court procedings. Its tough luck on him/her, he's obviously realise he's lost any hope of getting the money and is trying it on with you.

    My mum is a freeholder to many properties and she's had to have a charge put on someones lease because they wont pay up, and in the meantime is involved in litigation to recover the costs. This is what your FH should have done.

    Double check you haven't agreed to taking on the debt though anywhere in your contracts.
