War Pension and taking their money back

I suffered an accident in the forces, was medically discharged and made a claim. It was 2003 when I had the accident. They paid out for my injuries, loss of likely income and the like and I recieved a 50% WP. The WP is around 77ounds a week for 50%, but I receive 35of it and the rest, just over 40 per week goes back to pay for third party compensation. I am in effect repaying the money that they gave me to compensate me for my injuries in the form of a loan. I am 34 now and if I am fortunate (?) enough to live to ninety I will have repaid over 150k.......Does anyone think this is fair? Is this legal?
I thought the pension was designed to pay you for the percentage of disability not how much money you may or may not have. They paid me the compensation because the incident was there fault, now they take it back with the other hand...

just for the record the compensation was nowhere near 150k....as if they would part with it.....besides it is surely the insurers that pay the compensation if there is any. If that is the case then mod getting paid for my injuries too....0

Hi Kez, have you actually asked them what the deduction is exactly? If it is to repay the compensation payout, then they will (we hope) only take the amount they want to claw back, meaning that once paid you should receive the full WP.
First port of call is RBL, SSAFA or one of the single service organisations depending on which one you served in. Good Luck0 -
I will look into that then, at least it might stop one day then. I am only 34. They said it was deducted for Third Party Compensation, whatever that means long term. Thanks for your message0
