Section 8 help

Hi there, we own 2 HMO properties. I have two problems that i need help on
1- a tenant went on hol for 2 weeks and returned 6 months later. I pinned a section 21 to his door but he has the keys. I could not rent out room as all his belongings were still in there . Also he is slovakian and has little or no English. What are my options now?
2- I have two girls in two separate rooms . Unfortunately their behaviour is upsetting the other tenants. Food going missing late night partys, bringing pets into the property then leaving them for a couple of days so we had to break in rooms and feed /rescue them. So we want them out asap. Is there anyone out there that can confirm section 8 procedure?

    Section 8 is if they are not paying their rent - google housing act 1988 and grounds for possession. SOunds like for the 2nd pair, you need grounds 12 and 14. To be honest, both of these are discretionary. I'd go for a S21 notice, properly served for all three tenants. Once this has been done, you will have to go to court to enforce it and fix a date for possession if they haven't left when it expires

    Are these occupants on separate tenancy agreements? Are they still within the Fixed Term of their tenancies?

    Do any of them have rent unpaid and if yes how many weeks/months worth?

    Have you scheme registered their tenancy deposits and given the Ts the scheme's "prescribed information"?

    two of the tenants came through a bond scheme, so i cannot register those. the third owes over £1400 as i could not serve any documentation as he went on holiday for 2 weeks and did not return for 6 months.He was working for us so his rental was at a reduced rate of £32.27 which is the maximun an employer can take from an employee without affecting min wage. although now he his back we have replaced him and P45'd the employee/offending tenant as we could not keep his job open for 6 months. i would love to join a landlords association but in the present climate we cannot afford the fees.
  • re- Nikki1520 I thought ground 14 was not discretionary and i could go for immediate possesion. section 21 requires at least 2 months notice does it not? do i have to notify court when i serve section 21? or just after it expires and obtain docs from court to aquire property back.

    To issue a S8 ground 8 there needs to be 2 months rent owing, so if not paid on the first due day then again not paid on the next due day that is 2 months owing because it is supposed to be paid in advance, get it? It means you can issue the notice after 1 month and 2 days. There is a 14 day notice period before you can apply to the court for possession.

    Ground 14 means you can apply for a court date immediately it's issued, it's really only good if the tenant has been involved in something arrestable and found guilty, it's also discretionary and judges are reluctant to make people homeless.

    helped my brother and his family they were kicked out ot a house they were renting the landlord told them out with no warning and did not give them notice i told them ok for a couple of days but now i want them out they owe me for room rate for renting my room. I felt bad because he was left out in the cold with no shelter but now he is taking advantage of me and will not clean up or pay rent and i want him out. They have no lease and i need to know in the state of Pa how many business days can i give the homeless couple to evict them out of my house they need to move and they are not.

    I even told them section 8 is looking for people for their housing they gotten !!!!ed at me and now is avoiding me any advice to get these people out of my house..

    Firstly, please punctuate, it's really difficult to follow what you've typed.
    Secondly- this is a UK forum, and if I'm correct, you're based in Pennsylvania, America. Any response you get here will be based on UK law, and will be useless to you.

    Are you in Pasadena? We're in England and our laws are not going to be the same as you Colonials have. Sorry, oh, it's always a good idea to start your own thread rather than hi-jack someone else's.

    Thats very short sighted you could save the fees, purely in legal advice, also it is deductable against rental income.
    Also just to add you could have served notice on your tenant in their absence (information you could have recieved for free from a landlords association.

    If you cannot afford the 398 to join the NLA how are you managing to pay for the upkeep etc of your properties
