I have heard this, that you need to send in GP notes to receive assessment phase whilst waiting for appeal to be heard, unfortunately not all JCP advisers know what to tell benefit claimants.
Do seek help with the appeal, i have found that regardless of disability if you can do any job you are found fit for work which can include answering a phone, driving or sitting for a length of time, assessments are very hard unless you have severe mental health problems.
With your husbands disability you may qualify for DLA which is not work related.
Example: Disabled person found fit for any work and meets the criteria for DLA due to care and mobility needs.Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.0 -

Well it depends on your lifestyle choices but there is no legal minimum for benefits, just what you're entitled to. This could be £50,000+ or what I'm entitled to: £0.0 -

Does it not say somewhere on the JSA that this is the minimum amount the law/goverment says you need to live on? Always found it strange if this is the case when they expect you, or you need to, then pay money from it to-wards your housing cost.0 -
Its 105£ a week for childless couples. For children its £105 a week plus the benefits for children.

I think I understand what you mean, you are asking what the minimum amount the law says you are allowed to live on, in other words what you would get by law if you were claiming various benefits, they would take into consideration what you already recieved.

This site gives you all the rates for 2012 so it should give you some idea of what you would be entitled to and how much you would be expected to live on. They give whats needed for basic living, gas electric etc, they dont take into account any debt you may have like loans or credit cards (so I have been told).not all on benefits are scroungers and don't need to be bullied!0 -

Did you send in any supplementary medical evidence with the appeal?

When giving examples, be careful of the figures and unit of measurement you use, as it could be misleading.
If his head and neck went in a full circle = 100%
65% = over half 'way round' plus a bit.
I would use degree's to show movement, so my head would go 90 degrees to left and right totalling 180, anymore and I would be an owl.
You may understand what you mean, but if I read your statement like this, so may other people.

When you sent in your appeal, you should have also said, " I wish to claim ESA at the assessment rate whilst appealing", and you also need to send in "fit notes" from your GP. You also need to gather as much evidence as you can towards your appeal, eg: GP letter, Consultants lettters etc etc. My son is going through this at the moment, so I know the above is correct. Also try and get help from a welfare benefits officer, or the CAB, but I believe they are really stretched at the moment funding wise. Good luck
my sons appeal has taken 5 months, his appeal is on Monday 12th March0
